Recently imposed was the Governments' Climate Change Bill 2008 which requires that each building in your organisation has Commercial Energy Performance Certificate (EPC) whenever a commerical property is either rented or sold.

Amendments to current legislation are likely to come into force very soon, which will mean that for commericial property owners and agents;

The seller must ensure that an EPC has been commisioned before the marketing of a property

The person acting on behalf of the Seller/Landlord (e.g Commericial Agent) must be satisfied that an EPC has been commisioned before marketing of a property.

A new duty for both the Seller and the person acting on their behalf of the Seller/Landlord to make reasonable effort to secure an EPC WITIHIN 28 DAYS.

All of the new duties will carry fixed penalty fines where the Seller and Agent fail in their duties under the legislation.
