Terms and conditions
of sale :-
These terms and conditions
govern the supply of services by RJEnergy Ltd pursuant
to website order and orders placed by telephone, post
or email. Defined terms are capitalised and definitions
appear at the end of this document.
- Contract Process
- Where you submit your instruction
to us on our website or by email, direct to
us at http://www.rjenergy.co.uk
Ltd
- You will receive an electronic confirmation
of receipt of your instruction and of the date
of your instruction as soon, as is reasonably
practicable.
- You will not be able to alter the
details of your instruction once the instruction
has been placed in our order processing system.
(This does not affect the rights of consumers)
- Where you submit your instruction
to us by telephone or by post
- You will be notified if the service
is available or if your instruction cannot be
fulfilled for any other reason.
- No binding contract is formed until
we have placed the instruction in our order
processing system.
- We will retain a copy of the contract
for 15 years in the case of all instructions,
the contract for which will be kept for 15 years.
We strongly advise you to keep a copy for your
records.

Obligation
to supply
- We are only liable to supply you
with those services, which you describe accurately
in your instruction.
- Delivery
- We will carry out the energy assessment
during normal business hours within 5 days of
the date of receipt of your instruction.
- Where we cannot deliver the service
whether due to force majeure event or other
wise, in accordance with the time scales envisaged
at 3a. We will advise you and give you the option
to cancel your instruction or to accept a revised
appointment date.
- Warranty
These terms and
condition do not affect any statutory rights you
may have.
If you believe
that the service was not of a satisfactory quality,
you may, within 30 days of the instruction notify
us in writing stating the reason for your dissatisfaction.
If the nature
of the dissatisfaction can not be resolved between
the client and accredited assessor, the complaint
will be escalated to the accredited scheme provider
as detailed in these terms and conditions.
- Payment
- You shall pay our invoice of the
service on completion of energy assessment.
Unless prior arrangement has been made with
RJEnergy Ltd.
- If you do not pay sum due here under
by the date for payment, we will charge interest
on any outstanding amount at the rate of 3%
per month above the base rate of the Bank of
England from the due date for payment to the
date payment is made.
- All payment shall be made in pounds
sterling. You are responsible for paying any
Bank transaction charges in addition to the
price.
- Any prior arranged payments for the
price of services shall be made within 28 days
of the date of our invoice unless our head of
sales or credit controller has agreed otherwise
in writing.
- Intellectual Property Rights
- You will no do, or permit to be done,
anything that may detrimentally affect our copyright,
these mark or any other intellectual property
rights in the goods.
- You may cancel your instruction at
any stage before the instruction has been placed
in our order processing system.
- Waiver & Survivability
- If any provision of these terms and
conditions is found by a court or administrative
body of competent jurisdiction to be invalid
or unenforceable, it shall not affect the other
provisions these terms and conditions which
shall remain in full force an effect.
- Communications
- Notices shall be delivered to us
at the address set out in these terms and conditions
to you at the address to which the invoice is
sent or such other address as either party notifies
from time to time.
- Variation
- These terms and conditions are the
only terms, which apply to this contract. Any
variation to these terms and conditions is valid
only if it is agreed in writing by our head
of sales or our credit controller.
- Headings
- The headings used in these terms
and conditions are for guidance only and shall
not affect the interpretation of these terms
and conditions.
- Governing Law and Language
- These terms and conditions shall
be governed by English law and shall be subject
to the non-exclusive jurisdiction at English
court.
- These terms and conditions are written
in the English language and all notices and
communications shall be in the English language.
In the event that these terms and conditions
are translated into another language, the English
language will prevail
- Definitions
“Contract”. Means the
agreement between you and us, which these terms and
conditions, made by our acceptance of your instruction.
“Client”. (You, your)
means who ever places the instruction for services with
us.
“Instruction” Means
any assessment offered for sale by US and requested
by you in the instruction.
“Force Majeure Event”
Means any circumstances beyond our reasonable control
including (but not limited to) accidents, flood, fire,
natural disasters, industrial disputes, as a result
of which the services are unavailable.
“Price” Means that
amount quoted in our current price list from time to
time and any applicable value added tax or other taxed
or duties.
Energy Assessor
A qualified accredited expert, certified to perform under the accredited scheme provided to carry out energy performance assessment and subsequent production of energy performance certificates.
Energy Assessment
A short survey of domestic dwellings to determines the energy efficiencies of that dwellings.
Energy Performance Certificates
A certificates produced using government energy performance rating calculations using the latest SAP calculation methodology.
Accredited scheme provider a government accredited body for the issue and endorsements of standard assessment procedures (SAP) rating assuring domestic energy assessor are fit and qualified and undertake the work.
